For example, you are asked to choose your location upon registration to the Service so that we are able to deliver the Service to you. Even if you do not use our location-related features, we may use IP addresses and other information like phone number area codes to estimate your general location (e.g., city and country). We may also use your location information for diagnostics and troubleshooting purposes.
  • Cookies and similar technologies. We use cookies and various traffic tracking technologies such as web beacons and embedded scripts to monitor use of our Services. A cookie is a small piece of data (text file) that a website, when visited by a user, asks your browser to store on your device in order to remember information about you, such as your language preference or login information. As an example, timestamps of connections may be used to calculate peak times of service demand in order to plan the network capacity; to manage the number of concurrent active connections, and handle abuse; to troubleshoot our Services. Application events, such as auto-connection, crash reports or uninstall event, may be used by us to plan product development and analytics – we would look into things such as ‘how many users do we have’ or ‘are users uninstalling after our latest release?’ or ‘is the app crashing on a specific device?’

For personal data collected in the EU/EEA, the UK and other relevant jurisdictions, we will process personal data on the basis of our legitimate interest in undertaking the above business related activities where it is necessary for the adequate performance of any contract we may have with you or to comply with the law and/or on the basis of your clear and informed consent (as applicable).


Managing And Retaining Your Information


You may access the personal information we maintain about you that is collected from our Services, correct inaccuracies in such personal information, and have such personal information deleted. You may also object to our processing of your personal information collected from the use of the Services. Please note that you may not be able to benefit from all features of the Services if you request the deletion of your personal information or object to or withdraw your consent to such processing. If you would like to verify the personal information we have received from you or make corrections to it, you may contact us directly at requests to access, change, or remove your personal information will be addressed within thirty (30) days.

Unfortunately, the transmission of information via the Internet is not completely secure. Terms of Service

These Terms of Service (“Terms”) govern your use of the Musemind (AI Chatbot and Image Generation Bot (collectively referred to as “Musemind”) provided by 8peaks. By using Musemind, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use Musemind.

  1. Use of Musemind: a. Musemind is designed to provide chat-based interactions and generate images based on user input. b. You must be at least 18 years old or the legal age of majority in your jurisdiction to use Musemind. c. You are responsible for the accuracy and legality of the information you provide to Musemind. d. You may not use Musemind for any illegal or unauthorized purpose. e. You may not use Musemind to harass, threaten, or harm others or to violate their privacy rights. f. You may not use Musemind in a manner that could disrupt, damage, or impair the functionality of Musemind or interfere with other users’ access to Musemind.
  2. Intellectual Property: a. All intellectual property rights in Musemind, including any generated images or content, are owned by 8peaks or its licensors. b. You may not modify, reproduce, distribute, or create derivative works based on Musemind or any content generated by Musemind without the express written permission of 8peaks.
  3. User Content: a. By using Musemind, you grant 8peaks a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display any content you provide to Musemind for the purpose of operating, improving, and promoting Musemind. b. You represent and warrant that you have all necessary rights to grant the above license and that the content you provide does not infringe or violate any third-party rights.
  4. Privacy: a. 8peaks may collect and process personal information in accordance with its Privacy Policy, which is incorporated by reference into these Terms. b. Musemind may collect and store user data and interactions for the purpose of improving Musemind’s performance and functionality.
  5. Limitation of Liability: a. Musemind is provided on an “as is” and “as available” basis, without any warranties or representations, express or implied. b. 8peaks shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of Musemind or these Terms.
  6. Renewal: Musemind offers various subscription plans (such as daily, weekly, monthly, or annually), which can be selected depending on the Service when purchasing the subscription. At the end of each period, your subscription will automatically renew under the exact same conditions unless You cancel it by providing a minimum 30-day notice or Musemind cancels it in accordance with this Agreement.
  7. Cancellation: You may cancel Your subscription renewal through Your account settings page. You will not receive a refund for the fees You already paid for Your current subscription period, and You will be able to access the Service until the end of Your current subscription period. Further, Musemind reserves the right to offer additional cancellation rights which would be specified upon purchase, such as a right to cancel the subscription for free within first 30 months of subscriptions of 6 months or longer.
  8. Termination: a. 8peaks may, in its sole discretion, suspend or terminate your access to Musemind at any time and for any reason, without prior notice. b. Upon termination, the provisions of these Terms that by their nature should survive termination (including but not limited to intellectual property rights, user content, and limitation of liability) shall continue to apply.
  9. Modifications: 8peaks reserves the right to modify or update these Terms at any time. It is your responsibility to review these Terms periodically for any changes.
  10. Governing Law: These Terms shall be governed by and construed in accordance with the laws of United States. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
